Red Flag Laws Are Unconstitutional!!

Following the most recent mass shootings in El Paso, TX and Dayton, OH, both Democrats and Republicans alike are debating how they can convince the American people to surrender their second amendment right!

What Are Red Flag Laws?

The debate has raged on over background checks as being the weak point when it comes to criminals getting their hands on firearms. What many who speak out about this issue fail to divulge is the fact that criminals do not undergo background checks before getting their hands on the firearms they use to commit crimes. As a result, the only people undergoing background checks are the law-abiding gun owners who aren’t the ones going out and shooting up their local Walmart!

Since background checks seem to be the go-to solution this time around, the powers that be have decided to double down on the idea of background checks by coming up with what they call “red flag laws”. These new laws they would like to implement remain quite vague, but the basic idea behind these laws appears to be the notion that one can be “red-flagged” if someone close to that person happens to feel the individual may somehow be a threat to him or herself and or those around them.

This law completely disregards the fact that the person deemed the “threat” could be a legal gun owner who is not actually a threat at all.  There are countless scenarios in which these laws could and would be misused.  Take for instance a completely normal argument between a couple and one person decided to report the other as a “threat” just to enact revenge.  The person who is deemed a threat could have their 2nd amendment right revoked while their 4th amendment right is being violated as law enforcement would have ability come in a seize weapons without due process.

These new red flag laws may sound great – in fact they may even sound like a reasonable solution to the “gun problem” we face in the country today. What many supporting these laws fail to see is the real possibility that these laws lay the groundwork for the government to not only encroach on our 2nd amendment right to bear arms, they basically do away with our 4th amendment right to be secure in our persons and possessions.

The amendment we are surrendering if these laws go into effect is as follows…

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

So we must ask ourselves which is more important, do we continue to let the government erode our rights by exploiting tragedies as we witnessed with these recent mass shootings? Or do we stand up for the Constitution knowing that at the end of the day ones right to protect oneself and one’s family is paramount!
